This Agreement is made effective as of the payment date, establishing a binding relationship between The Client and Al Rahming Photography. It outlines the services and products detailed below, referred to as “Shoot(s)” or “Addon(s).”
Entire Agreement: This agreement represents the complete understanding between the parties, superseding any prior agreements. Any modifications must be made in writing and signed by both parties. If any part of this agreement is deemed invalid, the remaining provisions will remain enforceable. Waiving or failing to enforce any provision does not imply a waiver of others.
Booking, Cancellation, Payment & Rescheduling: To secure your booking, a non-refundable retainer fee is required within seven days of booking. If the session is within seven days, immediate payment is necessary. Unpaid bookings will be canceled after seven days.
Payments: Electronic payments are accepted. For cancellations or rescheduling, the retainer fee is retained. The Client is responsible for any material charges incurred before cancellation. Upon payment settlement, you’ll receive a confirmation email. Cancellations must be made at least one week before the scheduled shoot.
Shoot Schedule: The Client must confirm the venue at least one week before the scheduled date, except for weddings. Notify the COMPANY of any venue changes.
Safety: The COMPANY reserves the right to cease coverage if there is inappropriate, threatening, or hostile behavior from anyone present, or if the photographer’s safety is compromised.
Shooting Time & Additions: Punctuality is essential. The shoot starts at the scheduled time, and any additional time will be billed. The CLIENT is responsible for travel expenses unless explicitly provided by the CLIENT.
Responsibilities: The COMPANY is not liable for circumstances beyond its control, such as disruptive guests, tardiness, adverse weather, scheduling conflicts, inaccurate addresses, decorations, or location restrictions. The COMPANY is not responsible for unfavorable backgrounds or lighting conditions that may affect photo quality. The COMPANY cannot guarantee coverage of specific individuals or objects.
Venue, Permits & Location Limitations: The COMPANY operates within the location’s rules and guidelines. The CLIENT is responsible for negotiating any adjustments and obtaining required permits.
Copyrights & Model Release: The COMPANY owns the copyrights to the photographs. You may share them on social media, with family, and on vendor websites, with proper credit to the COMPANY. The COMPANY grants itself the irrevocable right to use and publish the photographs for any lawful purpose. You waive any claims to profits from the COMPANY’s use of the images.
Limit of Liability: If the assigned photographer cannot fulfill the contract due to unforeseen circumstances, the COMPANY will try to find a replacement. If unsuccessful, the COMPANY’s liability is limited to a refund. In case of lost or damaged files due to reasons beyond the COMPANY’s control, liability is limited to a refund or prorated amount based on the percentage of lost exposures. The COMPANY is not liable for any loss of images beyond the final delivery of the included products.
Delivery, Post Production & Printing: The COMPANY selects the images to be delivered. Clients can request additional images within 30 days. The COMPANY has full discretion over editing styles and aesthetics. To print the images, clients must obtain permission from the COMPANY. We can assist with printing recommendations.
